Adverse Action Notices

 

Per FCRA requirements, before you proceed with an “Adverse Action” against an applicant or employee based in whole or in part of an ESS report, you are obligated to provide the applicant: (1) a copy of the report and (2) a Summary of Consumer Rights document.  After the applicant has had an opportunity to dispute or explain information contained in the report, then you should send an FCRA compliant Adverse Action letter.  

 

Compliance with Adverse Action Notices as required by federal law takes time and timing.  Let ESS take care of that process for you.

Copies of Reports to California (OK, MN) Residents

 

Per California Civil Code 1786.16, a job applicant or employee in California must be provided with a copy of the ESS report when s/he has requested it on the disclosure and authorization form. The same is true in Oklahoma and Minnesota.

Currently ESS emails you a reminder to send the applicant/employee a copy of the report.  Now you can simply have us handle the job for you.
