The Nature of Statewide Criminal Searches
While the geographical
coverage of an entire state is preferable to
that of a county, not all states allow non
criminal justice entities access to their
information. Of those states that do allow
open access, some of the repositories are
woefully inadequate to be relied upon as the
primary search for that jurisdiction.
Texas is a prime example: It offers open
access to the Texas Department of Public
Safety which purports statewide coverage;
however, several studies have shown that
only 60% of the counties claim to regularly
report criminal data to the state
repository. (In the case of Texas, the DPS
data is regularly updated in our ANCI
database). There can also be significant
delays in court information to the DPS.
Other states have similar issues with their
repositories, and in these states ESS
defaults to county searches as the primary
source.
ESS will take advantage of the geographic
coverage offered by a statewide search when
the source is a judicial information system
that is comprehensive, complete with
identifiers and disposition, and kept
up-to-date in real time (or within 24
hours). There are about 12 states to which
this applies and we are now adding Nevada to
this list.*
The Nature of Nevada
Traditionally the
State of Nevada has restricted its criminal
history database for use by those for whom
it was created -- law enforcement and
criminal justice agencies. When the Nevada
Department of Public Safety first made
record searches available to civilian
purposes, it lacked comprehensiveness. The
biggest pitfalls were that it did not in
clude data from the City of Las Vegas
Municipal Court, and disposition information
was missing from several other courts.
Furthermore, a written request was required
to be mailed to the State causing long
turnaround times.
Currently the Nevada repository is the most
comprehensive and quickest way to find
criminal information, as all arresting
agencies and all 59 criminal courts report
to it and is now available to Nevad Licensed
Investigators. (DPS have designated
specific personnel for verifying any
questionable or incomplete records.) Since
