Interactive Report Order Form. This form conveniently allows you to open
it on your screen, fill in the blanks and click on the report components
you wish to order. In addition it automatically fills in and totals your
order for you. Then simply print it out and send it in. That's all there
is to it.

| The ESS Report Summary and Alert Notification | ||||
| We’ve had tremendous feedback on the ESS Report Summary and Alert
Notification that appears on the first page of your ESS Report. At a single
glance you can see all the components that comprise your report as well as
the turnaround time, component status, and alert status for each. Turnaround Times: If you do not have access to your reports via our Internet Report Access System (IRAS), then you may wonder why some of the turnaround times are extremely quick but you did not receive your report until 48 to 72 hours after submittal. That is because the ESS report is faxed or emailed to you when it is complete, at 72 hours, or according to your instructions, but clients using IRAS can check the status of their reports within a few hours of submittal. (Call us to learn more about the IRAS program and how to get set-up.). Component Status: Each component of your report has a status of Complete, Pending, or Not Available. Complete indicates the source was successfully contacted and a result entered. Pending indicates the source was successfully contacted, but a result has not be received. Not Available means the source was never contacted. Examples of the latter status include situations where we are instructed not to contact an employer, or we could not locate a current phone listing for a business. Alert Notification: Although we recommend that every ESS Report be read thoroughly, the Alert Notification provides an initial indication of areas that may be of special concern. The Alert does not necessarily mean ESS is reporting negative or discrepant information, although that would be one reason for the Alert. The Alert may also serve as an advisement, such as to re-verify certain identifiers and resubmit if necessary, or to consider additional criminal searches based on other names found. ESS is now sending the Report Summary / Alert Notification on a separate page. Under certain conditions you are required to provide a copy of the ESS Report to the applicant. Since the Report Summary / Alert Notification is intended as a way for our clients to easily review the contents and status of their reports, we suggest you provide applicants the ESS Report only. This could save the applicant much undue concern. The applicant may not understand the various reasons for the Alert and may assume the Alerts mean he/she is not being hired, or that the Alerts are the reason why he/she is not being hired, which may be far from the case. |

| New FCRA Section to Take Effect March 31, 2004 | ||||
Vail Letter Regarding Investigations into Workplace Misconduct is RepealedOn February 4, 2004, the Federal Trade Commission (FTC) announced that the new amendments to the Fair Credit Reporting Act (FCRA) concerning the investigation of current employees for suspicion of misconduct would take effect March 31, 2004. The new law effectively repealed what had been known as the “Vail” letter. In a 1999 staff opinion letter, the FTC held that the full FCRA notice and disclosure rules that apply to employment screening also must be followed when it comes to any misconduct investigations of current employees. This was heavily criticized by human resource, legal, and security experts as crippling investigations of sexual harassment claims, as well as other misconduct such as theft or workplace violence. Amended in late 2003, the FCRA will exempt third party investigations of current employees from many of the FCRA notice and consent requirements when the investigation concerns suspected wrongdoing relating to employment. If adverse action is taken as a result of such an investigation, the employee is still entitled to a summary containing the nature and substance of the report, but not the names of individuals that provided information for the preparation of the report. Many state consumer laws
already provided for this specific exemption, which previously conflicted
with the FTC ruling. Employment Screening Services will provide more
detailed information in the future as the implications of the new law
develop. |

| Pennsylvania Department of Transportation Tightens Leash on Access to Driving Records | ||||
|
The Pennsylvania Department of Transportation (PENNDOT) now restricts access to its driving records to only those entities they have specifically approved to have a permissible purpose for the records. PENNDOT has implemented an approval and tracking system whereby they can determine the third-party end user of every driving record released. Furthermore, when a driving record is released for employment purposes, PENNDOT will notify the driver in writing and include the name of the company that obtained the driving record. Employment Screening Services has been approved by PENNDOT as an authorized pre-employment screener. Before we can obtain PA MVR’s, clients must complete a one time “Affidavit for Intended Use” form and return it to ESS. Approval takes approximately 7-10 days after which ESS will have instant access to PA MVR’s on your behalf. ESS no longer has any other means to obtain PA MVR’s except this process. PENNDOT reserves the right to audit the records of both ESS and approved clients to insure proper authorization and use of driving records.
